Ninth Circuit Court Dismisses Complaint That 'Diet' In Name Of Beverage Suggests Product Helps With Weight Loss

The 9th U.S. Circuit Court of Appeals, in San Francisco, unanimously decided Monday, Dec. 30, that Dr Pepper/ Seven Up, part of Keurig Dr Pepper Inc., did not lead people to believe that Diet Dr Pepper promoted weight loss by using the word "diet" in its name, Reuters reports. A California woman had sued Dr Pepper/Seven Up and had appealed the U.S. District Court for the Northern District of California's August 2018 dismissal of the case.
