· The 2023 Route Driver of the Year promotion (“Promotion”) is sponsored by Endeavor Business Media, 1233 Janesville Avenue, Fort Atkinson, Wisconsin. Mondelēz Global LLC is a co-sponsor. The Promotion is subject to all applicable federal, state and local laws and regulations.
· Nominations for entry in the Promotion must be submitted via VendingMarketWatch.com, by clicking the Route Driver of the Year survey link or going to URL: https://www.surveymonkey.com/r/RDOY-2023 or in person at the Automatic Merchandiser booth or the Mondelēz booth at the NAMA Show in Atlanta, Georgia, May 10-12, 2023. No other method of entry will be accepted. Follow all prompts and instructions you receive to complete a nomination form through any of the methods described above.
· Eligibility: Nominators must be: (a) legal residents of the 50 U.S./D.C; (b) employed by an active vending operation or a customer of an active vending operation; and (c)18 years of age or older (19 or older if a resident of AL or NE).
Nominees must be: (a) legal residents of the 50 U.S./D.C; (b) employed as a route driver of an active vending operation on the date of nomination and must remain so employed through the date on which prizes are awarded; and (c) 18 years of age or older (19 or older if a resident of AL or NE).

· Nominations must include route driver name, company name, address, e-mail address and telephone number of the nominee, as well as the name, company name, address, e-mail address and telephone number of the nominator. Nominators must complete the questionnaire on the nomination form or the nomination will be disqualified.
· Nominations will be accepted beginning at 12:00 a.m. CT on first day at the NAMA conference, and ending at 11:59 p.m. CT on December 31, 2023 (“Deadline”). The Endeavor Business Media computer is the official time keeping device. Endeavor Business Media is not responsible for entries that are corrupted or otherwise not received correctly or for any other problems or technical malfunctions that result in the failure of an entry to be correctly and promptly transmitted to Endeavor Business Media. Endeavor Business Media is not responsible for lost, late, garbled, incomplete, illegible or misdirected entries. Entries received after the Deadline, December 31, 2023, will not be accepted. Limit one (1) nomination per nominator.

By participating in this Promotion, Nominators and Nominees agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final in all matters relating to the Promotion.
· Qualified entries will be reviewed, and winners will be selected by a qualified panel of vending operators and Automatic Merchandiser (“AM”) magazine personnel ("the Judges") based on the criteria described below using the information provided on the entry questionnaire:
· Sales 20%; Safety 40%; Customer Service 20%; and Overall Performance 20%.
· Determination of the winners shall be made by the Judges in their sole and absolute discretion. The Judges’ determinations as to the winners shall be final and binding. If a nominee is an employee of a Judge, that Judge will recuse him/herself from the judging of that particular nominee.
On or about January 31, 2024, the Judges will choose three (3) winners -- two (2) runner up Winners and one (1) “Route Driver of the Year” Winner (each, a “Winner) – based on the scores they received in the judging process. In the event of a tie, the tied entry with the highest score in “Overall Performance” will be deemed the winner. Prizes will be awarded after each Winner’s eligibility is confirmed. Prizes will be awarded to the selected nominees. Winners will be notified by Endeavor Business Media by February 9, 2024, via telephone, e-mail and/or U.S. mail using the contact information provided to Endeavor Business Media at the time of entry (“Winner Notification”). Endeavor Business Media will have no liability for any Winner Notification that is lost, intercepted, or not received by the Winner for any reason. Each Winner must provide a valid driver's license or official state identification in order to claim the prize.
Runner Up Prizes: Each runner up Winner will be awarded a $250 check.
Nominator of the winner prize: $250 check. (Self-nominations do not qualify.)
Route Driver of the Year Prize: The Route Driver of the Year Winner will be featured in a one (1) page editorial profile in AM magazine in April 2024. The Route Driver of the Year Winner will be profiled, along with his/her company, in the April 2024 issue of AM.
The Route Driver of the Year Winner will also receive a $500 check and a trip for two (2) to attend the NAMA Show (location TBD) and receive their award at a ceremony sponsored by Mondelēz Global LLC – Approximate Retail Value (“ARV”): $2,400.
Trip package consists of roundtrip coach air transportation for two (2) (winner and one (1) guest) from major airport nearest winner's home (determined by Sponsor in its sole discretion) to Conference location; two (2) days and two (2) nights’ accommodations at a hotel determined by Sponsor in its sole discretion (one (1) room, double occupancy); round-trip ground transportation between winner's home and airport, airport to hotel and hotel to airport, and hotel and NAMA Show site; and tickets for two (2) to attend the NAMA Show.
If the prize cannot be awarded for any reason including cancellation of the NAMA Show, Acts of God, acts of terrorism, civil disturbances, work stoppage, COVID-19, other pandemic or any other natural disaster outside Sponsor’s control, Winner will receive a $500 Check. No compensation will be awarded for the difference in value between the trip prize and this prize.
Winner must travel on the dates determined by Sponsor in its sole discretion or prize will be forfeited. Travel and accommodations are subject to availability. Travel must be round trip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the prize description above, including but not limited to, additional ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, and taxes are the responsibility solely of winner. Unless child or legal ward of winner, travel companion must be eighteen (18) years of age or older (or the age of majority in his/her state of residence if majority age is over 18) as of the date of departure and must travel on same itinerary and at the same time as the winner. Travel companion (or winner, if travel companion is winner’s child or legal ward) must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor air travel is not required due to winner’s proximity to the NAMA conference, ground transportation will be substituted for round trip air travel at Sponsor’s sole discretion. No compensation will be awarded in lieu of air transportation. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Actual value of prize may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual value and ARV, if any.
· The Route Driver of the Year Winner must sign and return an Affidavit of Eligibility/ Liability and Publicity Waiver (where permitted) releasing Endeavor Business Media and Mondelēz Global LLC of all liability associated with the Promotion and the prize by the date listed in the Winner Notification in order to claim the prize. Failure to comply will result in disqualification, and the prize will be awarded to the runner up Winner whose score from the Judges was next-highest (after the original Winner’s score)
Use of checks is subject to the terms, conditions and policies of the issuer. All income taxes resulting from acceptance of prizes are the responsibility of the winners.
Total ARV of all prizes: $3,400.
In no event will Sponsor be liable for awarding more than the number of prizes stated herein.
· Information provided by nominees and nominators as part of the Promotion becomes the property of Endeavor Business Media and Mondelēz Global LLC and may be used by either party in conformity with their respective Privacy Policies: Privacy Policy | Endeavor Business Media and https://www.mondelezinternational.com/Privacy-Policy.
By accepting a prize, each winner consents to Sponsor’s and Mondelēz Global LLC’s use of his/her name, city, state, likeness, photo, and/or prize information in connection with the Promotion for promotional, marketing, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet and social media platforms, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. All prizes are awarded “as is” without warranty of any kind, express or implied, on the part of the Sponsor or Mondelēz Global LLC.
Employees, officers and directors of AM, Endeavor Business Media, Mondelēz Global LLC, their respective affiliates, subsidiaries and agencies, and members of the immediate families (defined as including spouse, biological, adoptive and step- parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are not eligible to participate.
· Endeavor Business Media reserves the right, in its sole discretion, to disqualify any entry it deems inappropriate for inclusion in this Promotion. Disqualification of a Winner may result from any of the following: (i) the Winner’s refusal to accept the prize; (ii) the Winner’s failure to execute and return the Liability Waiver or Publicity Release by the deadline in the Winner Notification (if applicable); (iii) the return of a Winner Notification as undeliverable; or (iv) any other non-compliance with these Rules. In the event of a disqualification of a Winner, the Winner’s prize will be forfeited and his/her prize will be awarded to the entrant who received the next-highest score from the Judges in the original judging process.
· The names of the Route Driver of the Year Winner and the runner up Winners will be posted on VendingMarketwatch.com by April 2024.
· Endeavor Business Media reserves the right to cancel, terminate, or suspend the Promotion in the event that the Promotion is unable to run as planned for any reason, including but not limited to infection of Endeavors’ computer(s) by computer virus, tampering, unauthorized intervention, fraud, and any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion. If the Promotion is terminated prior to the Deadline stated herein, the winners will be chosen from among all non-suspect entries received as of the date/time of termination based on the judging criteria outlined herein.
Any attempt by any person to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to disqualify and seek damages from any such person to the fullest extent permitted by law.
By participating, Nominators and Nominees agree to release and hold Endeavor Business Media, Mondelēz Global LLC, and their respective parent companies, subsidiaries, affiliates, directors, officers, employees and assigns, promotion agencies and agents harmless from and against any and all claims and liability arising out of participation in the Promotion or use or redemption of any prize (if applicable).
By participating, each Nominator and Nominee agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Jefferson County, Wisconsin; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys' fees; and (c) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed as if the invalid or illegal provision were not contained herein.
In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials or notifications and these Official Rules, these Official Rules shall prevail, govern and control.
